Minor Consent Policy

This policy explains how Neayu handles accounts, privacy, and counselling services for users under the age of 18. We are committed to protecting the rights and welfare of minors while providing appropriate access to mental health support with guardian involvement.

1. 1. Minimum Age Requirement

   Neayu services are available to individuals aged 18 years and above. If you are under 18, you may not register for a Neayu account or use our services independently. Minors between the ages of 13 and 17 may access counselling services only with the explicit consent and ongoing supervision of a parent or legal guardian.

2. 2. Guardian Consent and Account Management

   For users under 18, the parent or legal guardian must complete the registration process, provide verifiable consent, and assume responsibility for the account. The guardian's identity may be verified before services begin. The guardian will have access to account information including session scheduling, payment records, and communication related to the care plan.

3. 3. Parental Access and Privacy

   While Neayu respects the privacy of all users, for minor accounts the parent or legal guardian may have access to certain account information as permitted by applicable law. The counsellor will discuss with both the minor and the guardian at the outset what information will be shared and what will remain confidential between the minor and the counsellor, consistent with professional ethical guidelines.

4. 4. Confidentiality in Minor Counselling

   Counsellors providing services to minors will follow professional ethical standards regarding confidentiality. Generally, the content of therapy sessions is confidential between the minor and the counsellor. However, the counsellor may disclose information to the guardian or to authorities if required by law, or if there is a risk of serious harm to the minor or others.

5. 5. Limits of Confidentiality

   For minor users, there are important limits to confidentiality that both the minor and the guardian should understand. These include: suspicion of abuse or neglect, risk of self-harm or suicide, threat of harm to others, a court order, or any other situation where disclosure is required by applicable law. These limits will be explained by the counsellor during the first session.

6. 6. Guardian Communication

   Neayu may communicate with the parent or guardian regarding account-related matters including payment status, scheduled sessions, and platform updates. Clinical details of therapy sessions will not be shared with the guardian without the minor's knowledge, except in situations where disclosure is legally required or clinically necessary to protect the minor's safety.

7. 7. Emergency Disclosure

   If a minor user is at immediate risk of harm, Neayu may disclose relevant information to emergency services, the parent or guardian, and as otherwise required by law. This includes situations involving suicidal ideation, self-harm, abuse, or threats of violence. Our counsellors are trained to handle these situations in accordance with professional and legal obligations.

8. 8. Data Retention for Minor Accounts

   Information associated with minor accounts is retained in accordance with our Privacy Policy and applicable legal requirements. Parents or guardians may request deletion of their minor's account and associated data at any time, subject to legal retention obligations. Upon the minor reaching 18 years of age, the account may be converted to an independent adult account at the user's request.
